Terms of service

These terms are between Joe Moore, trading as JobGate (“JobGate”, “we”, “us”), Swansea, Wales (full postal address on request), and the business that signs up (“you”, “the customer”). JobGate is for businesses only. By creating an account or using JobGate you agree to these terms on behalf of your business, and confirm you're allowed to.

1. What JobGate does

JobGate is online software for construction sites: QR site sign-in, inductions and RAMS sign-off, timesheets, safety reports, permits and records. We provide it “as is”, as it stands at the time. We improve it over time and may change features, as long as we don't take away the core of what you pay for without notice.

2. Your account

• You're responsible for your office users, keeping passwords private, and everything done under your account.
• Tell us straight away at hello@jobgate.uk if you think someone has got into your account.
• You must give accurate details when you sign up, and keep them up to date.

3. Free trial and payment

• New accounts get a 30-day free trial. No payment is taken during the trial.
• After the trial you pay £5 per worker per month, with a £25 minimum per month. Your own staff count if they sign in at all that month. Subcontractor workers count if they sign in on 5 or more days that month. Visitors are free. The Usage page in your office shows who counts.
• We bill monthly in arrears through Stripe, by card or Direct Debit. Prices are shown without VAT; if we become VAT registered, VAT will be added at the going rate.
• If a payment fails we'll let you know. If it isn't sorted within 14 days we may pause your office. Site pages keep working for your workers while paused, so nobody gets stuck at the gate.
• We'll give you at least 30 days' notice of any price change.

4. Cancelling

• You can cancel at any time from Settings, or by emailing us. You pay for the month you're in; there's no notice period and no cancellation fee.
• After you cancel you can still sign in and download your records for 30 days. After that we delete your account data within 90 days (see the privacy policy).
• We can end your account with 30 days' notice, or straight away if you seriously break these terms, don't pay, or use JobGate unlawfully.

5. Your data

• Your data is yours. Everything you and your workers put into JobGate belongs to you. You can export it at any time.
• For the personal data of your staff, subcontractors and visitors, you are the controller and we are your processor. Our data processing agreement forms part of these terms.
• You're responsible for having a lawful basis to record your workers' sign-ins, location and documents, and for telling them about it. JobGate shows each worker a privacy notice on first sign-in to help with this.
• We only use your data to run JobGate for you, to keep it secure, and to work out your bill. We never sell it.

6. Acceptable use

Don't use JobGate to break the law, upload anything you don't have the right to, try to get into other customers' data, overload or attack the service, or copy or resell it.

7. What JobGate is and isn't

JobGate is a record-keeping tool. It does not replace your health and safety duties. You remain responsible for your RAMS, inductions, site supervision, checking competence, emergency procedures and roll calls. Location checks rely on workers' phones and can be wrong or turned off; treat flags as prompts to check, not as proof.

8. Availability

We aim to keep JobGate running all the time, but we can't promise it will never go down, for example during maintenance or a problem with our hosting provider. Keep a simple backup plan on site (such as a paper sign-in sheet) for those times. Your weekly emailed records give you your own copy.

9. Liability

• Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't be limited by law.
• Otherwise, we aren't liable for loss of profit, revenue, business, contracts or goodwill, or for indirect or consequential loss.
• Our total liability to you in any 12-month period is limited to the fees you paid us in the 12 months before the claim.

10. General

• We may update these terms. We'll email account admins at least 30 days before any change that affects you materially.
• Neither of us is liable for delays caused by things outside our reasonable control.
• These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
